Each term starting with a capital letter below has the meaning given to it in its definition set out in this article. "Terms of Use": means this document. "Special Conditions": means the terms and conditions of use specific to certain Services individually. "Services": means all or a part of the services provided by La Poste to Users accessible via the Site. In particular, the Services include the information made available to Users as well as the services for preparing and tracking post and calculating postage costs. "Site": means the web portal accessible at www.laposte.fr and/or at any other address that La Poste may replace or supplement it with. "Users": means any individuals or legal entities using one or more Services.
This document constitutes the Terms of Use of the Services. The purpose of this document is to set out the terms and conditions of use of the Services by Users. It is stated that use of the Services is subject to observing these Terms of Use as provided for in the following article.
La Poste provides the Services according to these Terms of Use. Certain Services may have specific conditions of use (the Special Conditions) that supplement the Terms of Use.
The Special Conditions form an integral part of the Terms of Use. If the terms, conditions and notices of the Terms of Use are inconsistent with the Special Conditions, these Terms of Use will prevail.
La Poste shall provide you with its Services provided that you undertake to observe these Terms of Use. We advise you to regularly refer to the latest version of the Terms of Use. In any case, you are considered to have accepted them by the mere use of the Services. Any use of the Services constitutes acceptance of the latest version of the Terms of Use.
The Terms of Use may be amended at any time by La Poste. In this case, the amended Terms of Use shall enter into force from their release online. We recommend that Users regularly read the Terms of Use. Users are considered to have accepted the latest version each time that they connect to the Services.
In order to use certain Services, you must complete a registration form and provide personal data. You undertake to provide accurate, complete and up-to-date information. If the information provided is inaccurate, incomplete or obsolete, La Poste will take any measure that it deems necessary to suspend your access to the service concerned, permanently or temporarily.
Users expressly give their consent so that their personal data collected as part of the registration procedures for certain Services is only processed for the purposes of these Services. In accordance with the provisions of the Information Technology and Civil Liberties Law of 6 January 1978, La Poste undertakes to only use Users' personal data strictly for the purposes stated above. La Poste expressly undertakes not to carry out any processing that is not compatible with the purposes of the Services, and not to publish, disclose or transmit any information concerning Users, without their prior consent. In accordance with the provisions of the Information Technology and Civil Liberties Law of 6 January 1978, Users have a right of access to and a right to rectification and erasure of their personal data, which may be exercised by email to: infos-perso.laposte@laposte.fr.
La Poste guarantees that personal data will not be transferred to third parties. This guarantee does not apply to processing for statistical purposes or historic or scientific research, in particular as part of sociological or scientific studies, when the processing concerned only deals with the data anonymously and globally. La Poste undertakes to implement the appropriate technical and organisational measures to protect the personal data against accidental or unlawful destruction, accidental loss, alteration and unauthorised dissemination or access. La Poste undertakes to retain the personal data for no longer than is necessary for the purposes for which it is collected or processed. La Poste may be required to disclose any information about you in order to comply with any law or regulation in force or to meet any judicial or administrative request. La Poste recommends the utmost vigilance concerning the dissemination of your data on communication Services (messaging, chat, forum), as this disseminated data may be collected and used by third parties without your knowledge.

La Poste reserves the right to use cookies in order to best ensure management of the Services, facilitate your browsing of the Services and to prepare statistics. If you so wish, you may refuse the cookies by changing your browser settings, in the majority of cases via 'preferences'.
To access certain Services, you must use a username and password. Your password is personal and confidential. You undertake not to disclose it to third parties in any form and capacity whatsoever and to immediately inform La Poste of any use by an unauthorised third party and of any breach of security that may result from this. You are solely responsible for keeping your password confidential and for any possible use of it.
La Poste reserves the right to change or temporarily or permanently shut down all or part of the Services, without informing Users beforehand.
The majority of Services are accessible via the Internet or some by other means of communication. The costs of connecting to the Services shall be covered by Users.
Where Users are minors, they shall state that they have the authorisation to use the Services from the person(s) with parental authority over them and that the person(s) with parental authority has(have) agreed to guarantee the minor's compliance with the Terms of Use. Any use of the Services by a minor is done so under the full responsibility of the person(s) with parental authority over the User concerned.
You undertake to use the Services in accordance with national and international regulations, and in particular not to use them to display, upload, download, send or transmit any content: of a violent nature or that may undermine the respect and dignity of the human person, equality between men and women and the protection of children and adolescents, in particular by the production, transfer and dissemination of messages of a violent or pornographic nature or that are likely to undermine human dignity; that encourages crimes and offences to be committed; that encourages the consumption of banned substances; that causes or may cause discrimination, hatred and violence due to race, ethnicity or nationality; that is illegal, harmful, threatening, abusive, defamatory, offensive, vulgar, obscene, that constitutes harassment or threatens the privacy of another or that is likely to offend certain people; that misleads other Users by stealing the name or company name of other people; that infringes the rights of third parties such as, but not limited to, any trade secret, professional secrecy, confidential information, trademark, patent and in general any industrial or intellectual property right or any other right concerning protected information or content; including, but not limited to, computer viruses or any other code or program designed to interrupt, destroy or limit the functionality of any software, computer or telecommunication tool.
You undertake to regularly read the Terms of Use and observe them, not to collect and store personal data related to other Users, not to harass in any way whatsoever one or more other Users, and not to hinder or disrupt the operation of the Services.
Should you breach these Terms of Use, access to the Services will be automatically blocked, without prejudice to any legal action that may be brought by La Poste and to any damages that may be claimed from you.
The Services may contain links to sites of partners of La Poste or third parties. La Poste has no control over these sites and shall therefore assume no liability concerning the availability of these sites, their content, advertising, and products or services available on or from these sites.
The commercial relationships whatever they are, which you may have at the time of using the Services with the partners of La Poste or advertisers on the Services, are directly with the partners or advertisers without La Poste being party to these relations. Therefore, La Poste may not be held liable for any harm that Users suffer as a result of their relations with partners of La Poste or advertisers.
Content such as in particular, but not limited to, texts, information, documentation, audio documents, photographs, drawings, plans, brands, packages, software, data, databases, graphic charters, visuals, avatars and in general any element appearing on the Site and/or available on the Services, are protected by intellectual property rights, without the express authorisation of La Poste and/or its partners.
The brands that appear on the Services are brands protected by La Poste and/or its partners. Any reproduction or use of these brands without the express authorisation of La Poste and/or its partners is strictly prohibited.
You undertake to indemnify La Poste and hold it harmless against any action that may be brought against it, or any complaint lodged against it, by a third party, due to use by you, or under the control of your username and password, of Services under conditions that do not conform to the Terms of Use. This indemnity shall cover any amount that La Poste is required to pay in any capacity whatsoever, including lawyers' fees and costs of proceedings acknowledged or ordered, within a reasonable limit. Use of the Services does not come with any guarantee whatsoever. La Poste does not grant any express or implicit guarantee concerning the use of the Services by Users and in particular regarding the availability, timeliness, currency, reliability and usefulness of the Services and their content.Similarly, La Poste does not guarantee that the content and services obtained by Users of the Services will conform to their expectations, and that the content and services provided comply with any regulation or third-party right.
You are responsible for the use of your username and password. Any connection to the Services and transmission of data made using your username and password will be considered to have been carried out by you. These provisions shall continue to apply including when you pre-store your username and password on your microcomputer, thus enabling automatic connection to the Services. Users state that they accept the characteristics and limits of the Internet and in particular acknowledge being aware of the nature of the Internet and specifically its technical performance.
La Poste may not be held liable in any capacity whatsoever in case of, but not limited to, changes to, suspension or shutdown of the Services.
Under no circumstances may La Poste be held liable for the reliability of data transmission, access time, or any restrictions on access to the Internet or networks connected to it. La Poste may not be held liable in the event of interruption to the networks for accessing the Services, full or partial unavailability of the Services due in particular to the telecommunications operator, in case of transmission error or problems related to the security of transmissions, or in case of a fault with the receiver equipment or your telephone line.
La Poste may be required to shut down its Services for maintenance reasons. This shutdown will be notified by means of a notice on the homepage or by any other process. La Poste may not under any circumstances be held liable for this shutdown and it shall not give any right to compensation.
Under no circumstances may La Poste be held liable for indirect damage and in particular any commercial, non-pecuniary and financial damage including any loss of profits, the cause, origin or foundation of which is the use of the Services or their content.
La Poste shall assume no liability related to the use of the Services or their content. The content and services provided by partners of La Poste via the Services are done so under the exclusive liability of these partners. Thus, La Poste shall in no way be liable for direct or indirect damage, occurring in particular at the time of Users' access to or use of the Services, the non-compliance of the Services or their content with any regulation or any infringement of third party rights.
You are solely responsible for any content (in particular texts, images or sounds) that you communicate to any third party via one of the Services, whether transmitted publicly or privately. Therefore, La Poste may not be held liable for content communicated by Users via the Services.
If any one of the clauses is held to be invalid, it will be deemed unwritten and will not affect the validity of the other clauses. Should La Poste fail to exercise any one of the rights arising from these Terms of Use, this shall not constitute a waiver to exercise its rights.
Any dispute that arises concerning the interpretation and performance of these Terms of Use shall be the subject of an attempt to find an amicable settlement. Failing an amicable settlement, the dispute will be subject to French law and brought before the competent court within the jurisdiction of the Paris Court of Appeal ruling under French law.
